Terms of Service

Agreement

These terms govern your use of the vithos.app website, the waitlist, and the Vithos desktop app (together, the "service"). The service is operated by Mehdi Chioukh, an independent software developer based in France ("Vithos", "we", "us"). By using the service, you agree to these terms. If you do not agree, do not use the service.

The service

Vithos is a keyboard-first, local-first mail client for Gmail. Your email content is stored on your device; our servers coordinate sync with Gmail and manage your account, as described in the Privacy Policy.

The waitlist

Joining the waitlist gives us permission to email you about Vithos. It does not create an account, guarantee access, or commit either of us to anything. You can unsubscribe at any time.

Your account and your Google account

To use the app, you sign in and connect one or more Google accounts. You must be legally able to enter into these terms and authorized to use each account you connect. You are responsible for what happens under your account and for keeping your devices secure.

Gmail access runs through Google's official API, under Google's own terms. You can revoke Vithos's access at any time from your Google account permissions. Vithos is an independent product and is not affiliated with or endorsed by Google.

Your content

Your email is yours. These terms give us no ownership of it. You grant us only the limited right to process it as needed to run the service (for example, syncing your mailbox and sending messages you write), consistent with the Privacy Policy.

Acceptable use

Do not use the service to:

  • break the law, or infringe anyone's rights;
  • send spam, bulk unsolicited mail, phishing, or malware, or otherwise abuse email delivery;
  • probe, overload, or disrupt the service, or access it by any means other than the app and interfaces we provide;
  • resell or redistribute the service, or misuse API access beyond your plan's limits.

We may suspend or terminate accounts that put the service or other people at risk.

Subscriptions and billing

Paid plans are sold through a third-party merchant of record, which handles checkout, invoices, and applicable taxes. Prices and what each plan includes are shown at checkout. Subscriptions renew automatically until cancelled; you can cancel at any time and keep access until the end of the paid period. Where required by law (including EU consumer law), you keep any statutory withdrawal and refund rights; otherwise, refunds are at our reasonable discretion.

Early access

Vithos is young software under active development. Features may change, break, or be removed, and access during any alpha or beta period may be interrupted. We work hard to keep sync reliable, but you should not treat Vithos as your only copy of anything: your mail remains in your Gmail account, which is always your source of truth.

Intellectual property

The app, the website, and everything that makes them (code, design, name, and marks) belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable license to use the app to access the service. You may not copy, modify, or create derivative works of the app except as permitted by applicable law.

Disclaimer

The service is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or secure, or that it will meet your requirements.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the event giving rise to it. Nothing in these terms excludes liability that cannot be excluded by law, and nothing affects the statutory rights you hold as a consumer.

Termination

You can stop using the service and delete your account at any time. We may suspend or terminate your access if you materially breach these terms, if required by law, or if we discontinue the service; where reasonable, we will give you notice first. Sections that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) survive termination.

Changes to these terms

We may update these terms as the service evolves. If a change is significant, we will tell you in the app or by email before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms.

Governing law

These terms are governed by French law. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and disputes may be brought before the courts of that country or of France.
